PUBLIC REQUEST FOR PROPOSAL (RFP) QUALIFYING EXCESS PERFORMANCE CREDITS April 6, 2023 Contact Information Name: Michael Partab All communication regarding this RFP must be coordinated through the representative above. A. About Call2Recycle Canada: Call2Recycle® is a not-for-profit organization dedicated to the preservation of the environment and supporting the circular economy, through its commitment to collecting and recycling as many household batteries as possible, across Canada. Call2Recycle is the provincially-approved consumer battery collection and recycling program for British Columbia, Saskatchewan, Manitoba, Quebec, and Prince Edward Island. Call2Recycle also operates as a registered Producer Responsibility Organization (PRO) in Ontario according to the Ontario Batteries Regulation. These provinces have established Extended Producer Responsibility regulations that require battery producers to fund or arrange for the collection and recycling of their battery products, after they reach the end of useful life. Call2Recycle offers a convenient turn-key solution for battery manufacturers to outsource the collection and recycling of batteries, enabling obligated producers to conveniently meet their responsibilities. Our members/customers include leading battery and electronic device manufacturers and retailers. Call2Recycle has over 10,000 drop-off locations across Canada, where consumers can conveniently and responsibly dispose of their batteries for recycling. Our collection boxes (and other commercial collection devices) can be found in major hardware stores, drug stores, office supply stores, libraries, post offices, municipal depots and other facilities. Other collection locations include private businesses that regularly use and dispose of batteries in the course of operations. Call2Recycle accepts household batteries (weighing up to 5 kg) for recycling, including single-use batteries (e.g. AAA, AA, 9V, C, D, button cell) as well as rechargeable batteries that can be found in cordless phones, cell phones, toys, and power tools. We also accept eTransport batteries used to power eBikes, eScooters, eSkateboards, and Hoverboards. In BC, Call2Recycle supports the recycling of eTransport vehicles in their entirety, as required by provincial regulations. Call2Recycle has also entered into the Electric Vehicle (EVs) battery recycling industry. Following their collection, batteries are sorted by chemistry and broken down to base materials which can be re-used to make new products. This diverts batteries from landfill, protecting the environment and also supports sustainability and the circular economy. Since its inception in Canada in 1997, Call2Recycle has diverted almost 40 million kilograms of batteries from Canadian landfills and meets or exceeds the most rigorous recycling standards for safe battery recycling and management. Call2Recycle is seeking to purchase qualifying excess performance credits for the following management requirement years: • 2021 C. Scope of Work: Call2Recycle Canada is seeking expressions of interest from qualifying Processors and Producer Responsibility Organisations (PROs) operating in the province of Ontario, for the purchase of qualifying excess performance credits for the management requirement years 2020 and 2021. In order to qualify, the following criterial must be met at (D) below, and requested information provided at (E) below, as part of the RFP process. D. Qualifying Criteria: • A qualifying processor or Producer Responsibility Organisation (PRO) that is registered with the Resource Productivity & Recovery Authority (RPRA). • A processor is defined as a person that processes batteries used in the province of Ontario for the purposes of resource recovery. • A Producer Responsibility Organisation (PRO) is defined as a business established to contract with producers in the province of Ontario, so as to provide collection, management and administrative services to help producers meet their regulatory obligations under the Batteries Regulation. • The excess performance credits must relate to qualifying batteries as defined by the Batteries Regulation. • The excess performance credits must relate to processed batters which were exclusively sourced/used in Ontario. • The qualifying volume must adhere to Part IV of the Batteries Regulation with respect to the three months limitation of carried forward volume. • The qualifying Processors and Producer Responsibility Organisations (PROs) must be in a position and have the ability (in the first instance), to sell excess performance credits. This should be demonstrated through out the RFP process. Additionally, the qualifying Processors and Producer Responsibility Organisations (PROs) should be prepared to independently verify the above claim to (i) Call2Recycle Canada and (ii) the Resource Productivity & Recovery Authority (RPRA), with respect to the foregone position/claim. E. RFP Requested Information: • All proposals submitted as part of the RFP process must include the following information and documentation. Incomplete submissions will not be considered and will be excluded from the RFP process. • Corporation/business Information: explanation and documentation supporting the legal standing of your company or business (e.g. certificate of incorporation or business registration documents). • Business activities: a detailed explanation of your company/business operations which should include: background, scope & scale of activities, number of employees, number of collection sites, and listing of processing sites and/or processing facilities used. • Resource Productivity & Recovery Authority (RPRA) Compliance Information: documentation supporting both (i) historical registration with the RPRA for the performance years 2021 and 2022 and (ii) up to date registration for 2023. • Qualifying Volume: a detailed breakdown of the qualifying volume by battery type (primary vs. rechargeable) for each of the years 2021 and 2022. Please refer to the RPRA on battery reporting guidelines. The volume should be reported in KGs and the chemistry type should also be specified. Additionally, supporting explanations and documentation should be provided which demonstrates that the qualifying volume were collected during the foregone mentioned years, and processed within 90 days by an approved processor. • Validity of Excess Performance Credits: supporting explanations, calculation and/or documentation demonstrating the validity of the excess performance credit volume. Specifically, the submitted excess performance credits should not have been counted towards the management obligation of any other program in Ontario or in other provinces. The onus will be on the submitting organisation to prove that the credits are compliant with the Batteries Regulation. • Source of Qualifying Volume: supporting documentation and explanation relating to the source of the volume. Only volume collected in Ontario and processed by approved processors will be considered for this RFP (i.e. volumes sourced/collected outside of Ontario, even if processed by approved processors, are ineligible). Supporting documentation may include collections report, bill of lading, shipping documentation, certificate of destruction or such other evidence as Call2Recycle Canada may request. • Pricing: a detailed breakdown and calculation of the pricing offered for the excess performance credits. This must include (i) price per KG and (ii) total price. Applicable sales tax (GST/HST) should also be specified. • Contact Information: provide email, phone number, and title of primary RFP contact. F. RFP Submission Date: • All of the information and documents specified at (E) above must be provided in full no later than Friday April 14, 2023, at 5:00pm EST. G. By submitting a Quotation in response to this RFP, you agree to accept and to be bound by all of the terms and conditions contained in this RFP and that Call2Recyle shall have the right without liability, cost or penalty and in its sole discretion to exercise any of the rights set out in this RFP. Security and Confidentiality The Contractor shall comply fully with all security procedures of Call2Recycle in performance of the Contract. The Contractor shall not divulge to third parties any confidential information or sensitive policy pre-deliberative information obtained by the Contractor or its agents, distributors, resellers, subcontractors, officers or employees in the course of performing Contract work, including, but not limited to, security procedures, business operations information, personally identifiable information, or commercial proprietary information in the possession of Call2Recycle. |
